December 2011 Community Update
We are a group of residents from East Harlem and Yorkville, as well as businesses and residential buildings who oppose the City's misguided plan to construct a huge new garbage facility at East 91st Street on the East River, adjacent to Asphalt Green and along the East River estuary. The facility will directly and irreparably harm the health, safety, and welfare of all our families and the community. As a result, we are working on multiple fronts to find sane alternatives to the construction of this facility.

Message from Jed Garfield, President RFSTS

The support from our community has grown every day since our association was launched in August 2011, by a group of concerned area residents who oppose New York City’s plan to construct a new and enlarged garbage processing facility (MTS) at East 91st Street and the East River.

This is our first newsletter in which we will highlight what we are currently doing to stop the solid waste processing plant from being built. 

I  recently issued  an important statement  with Tony Ard of Gracie Point Community Council regarding our efforts to defeat this proposed trash facility. 

“Please be advised that while Gracie Point Community Council and Residents for Sane Trash Solutions are active as separate legal entities, their joint goal remains the same, the elimination of the misguided and misplaced trash facility adjoining the Asphalt Green Recreational facility. Gracie Point Community Council and Residents for Sane Trash Solutions are and will continue to work closely together to achieve this goal.”

A number of members from our group have participated in a variety of meetings related to waste management including the  the  NY League of Conservation Voters conference, “Wasted Opportunity? Confronting NYC’s Solid Waste Challenges” As the announcement for the conference noted:

“New York City is lagging behind other major cities in the adoption of new technologies, even as our current system grows more and more expensive. Isn’t it time for the Big Apple to rethink its solid waste management strategy — and soon?"

We applaud the NY League of Conservation Voters willingness to confront the problems with the current and planned MTS to Landfill operation and the need to investigate new technologies. 

I would like to thank those of you who have joined and donated financially for your generous support. For those of you who are still considering joining our group, I cannot stress how important it is for us to join together as a community to protect all of our residents,as well as preserve the unique quality of life in Yorkville and East Harlem.

 We are working on many fronts in our community  and we encourage you to join, volunteer and contribute.

What We Are Doing!

Legal Initiatives
We have retained attorney, Albert  Butzel, Esq. to pursue available legal remedies. Mr. Butzel was lead council in the landmark Storm King Mountain case that defeated Con Edison's plan to build a giant power plant in the Hudson Highlands. He also defeated the plan for the proposed development of the Westway Project along the Hudson River. Mr. Butzel has won a recent victory in the litigation involving the Atlantic Yards development. Additionally, we have filed comments before the Army Corps of Engineers and an amicus brief in the New York intermediate appellate court to oppose insurance of permits to build the facility.

Lobbying Efforts
The group has retained lobbyist, Michael McMahon, Esq. from the law firm of Herrick Feinstein  to represent our interests before City and State officials. Mr. McMahon is a former congressman, as well as a former member of the New York City Council and served as Chairman of the Committee on Sanitation and Solid Waste Management. He is intimately familiar with the process that led to the adoption of the City's current waste management plan and has long opposed development of the East 91st Street Marine Transfer Station.

Community Outreach
Our initial efforts were instrumental in organizing a neighborhood rally this summer adjacent to Asphalt Green with Rep. Carolyn Maloney to promote and encourage a community letter writing campaign to the Army Corps of  Engineers during the public comment period to request that the Army Corps deny the permit for the construction of the new garbage facility, as well as request new scientific testing of the East River estuary (see Sen. Liz Krueger's update in this newsletter) . We continue to man tables and distribute information at Asphalt Green (see our Keep Asphalt Green Clean and Safe column in this newsletter). We have also documented the community's recreational use of the East River, including fishing adjacent to the site. We have the active support of many of our elected officials including Rep. Carolyn Maloney, State Senator Liz Krueger, State Assembly Member Micah Kellner, Council Members Jessica Lappin and Daniel Garodnick.  We encourage you to write to your elected officials to keep this important issue on their radar and demand updates and information. Many local community groups and organizations including: Community Board 8,  East 93rd Street Block Association, East 86th Street Block Associaiton, Upper Green,  the Parent Leaders of Upper Eastside Schools (PLUS) - the parents of 5000+ Upper Eastside public school children, the Manhattan Chamber of CommerceGracie Point Community Council, and Asphalt Green (read  Carol Tweedy's statement in this newsletter ) oppose the construction of this huge new solid waste plant.

Fundraising

We are actively fundraising in order to have the resources to fund our legal initiatives and lobbying efforts. Many of our contributions have come from  individual contributions,  building cooperative Boards and businesses.  The area in which we have concentrated our fundraising efforts includes those buildings and businesses located between 96th street and 79th street, from 2nd avenue to the East River.  We are also meeting with businesses, schools and local organizations.

Army Corps of Engineers Update
from State Senator Liz Krueger's  December 2011 Community Bulletin

"I am pleased to report that the Army Corps of Engineers has requested additional information from the Department of Sanitation before it will consider granting a permit to allow construction of the proposed Marine Transfer Station (MTS) on 91st Street. While it remains unclear what the final determination of the Army Corps will be, I am encouraged that this action shows that they are seriously considering the potential adverse impacts of the proposed MTS.  I, along with other elected officials and many community members had submitted comments to the Army Corps opposing the MTS. 
 
In order for the Army Corps to approve the permit, which is essential for the project to begin, the Dept of Sanitation must submit a revised in depth mitigation plan which includes removal of structures elsewhere in the East River, account for the use of dredged materials, and will also need to provide updated Essential Fish Habitat Assessments for any proposed mitigation sites. This is a bit of good news because this process with further delay the project, pushing its potential beginning phases further into the future.

Additionally, the public comment period with the Army Corps of Engineers remains open while the Department of Sanitation gathers the required information".

Keep Asphalt Green Clean and Safe

Asphalt Green's campus features a playing field and aqua center serving more than 100,000 vistors a year. Some of you may have given your name and contact information to one of our representatives while you were attending a sporting event at Asphalt Green. Our team has been handing out information about our group and trying to raise public awareness of NYC's plan to build a garbage station, 10 stories tall and the size of two football fields adjacent to the spectacular playing field at Asphalt Green which is in almost constant use by scores of children and adults. It is the home field of the Green Wave soccer team which hosts opposing teams from many areas of the city, the baseball fields for the younger age Little Leaguers of Yorkville Youth Athletic Association and the football field for the a league of Harlem Middle Schools.

Please read a recent statement from Carol Tweedy, Executive Director of Asphalt Green regarding the proposed MTS garbage facility and why this huge new plant would destroy the "backyard" for so many thousands of children who have benefited from the wide range of athletic programs of Asphalt Green

My name is Carol Tweedy and I am Executive Director of Asphalt Green.  We are a not-for-profit sports and fitness facility.  Our mission is captured by the phrase, “Sports and Fitness for a lifetime.”  We are committed to helping people develop the fitness habits that will bring them lifetime health.
 
Today, I pulled my files on the Marine Transfer station.  I reviewed the testimony that I have been giving to oppose the transfer station since 2003.  I have said the same thing, over and over again.  I was so frustrated by this repetition, that I could not put my attention to preparing remarks.
 
Later in the day, I had to tour someone through our campus.  There was the story.  Buses were lined up on York Avenue with public school children who were coming for our free learn to swim program.  And they were crossing the ramp area to get into the Aquacenter.  Another bus, was trying to make the turn at 90th street with another group.  There was already one school in the water.
 
The lobby was filled with a group from Gillen Brewer School, a school for children with learning disabilities up the block on 92nd St.  We do all of the physical education for those children and it has an enormous impact on their development and their school work.
